What Are the Requirements for Getting Family Residence Permit?

In order for the family residence permit to be issued, foreigners must meet the requirements stated in Article 35 of the Law.

The sponsor shall meet the requirements (the sponsor; shall has a valid health insurance covering all the family members, his or her monthly income is not less than one-third of the minimum wage per capita, be able to prove that he or she has not committed crimes against the family order in the last five years with a criminal record documentation, resides in Turkey not less than a year and being registered in the address registration system)

To meet the requirements of those who request a family residence permit to stay with the sponsor, (Submitting the relevant supporting information and documents for the purpose of staying in Turkey, showing that they live or intend to live with the specified persons, the spouses are over the age of eighteen, and not in the scope of Article 7 of the Law, the marriage is not for the purpose of obtaining a family residence permit)

What are the reasons for Refusal, Cancellation or Non-Extension of Family Residence Permit?

Failure to meet or not meeting the requirements for getting family residence permit anymore,

 be detected that the family residence permit has been misused.

The existence of a valid deportation or prohibition of entry to the country.

In such cases, family residence is not granted, if it is granted, it will be canceled, and expired ones are not extended.

Who Are Eligible to get Family Residence Permit

Turkish Citizens’, those who are within the scope of Article 28 of Law No.5901 or foreigners who have one of the residence permits, refugees and secondary protection status holders’;

Foreign spouse,

His or his spouse’s minor foreign child,

His or his/her spouse’s dependent foreign children

Are eligible to get family residence permit.

If the foreigner applying for family residence permit has more than one spouse, a family residence permit may be issued for only one of the spouses. However, family residence permit can be granted to all children of the foreigner.

For the family residence permit requests of children outside of our country, if any, the consent of the parents who have joint custody is required.

Family residence permit provides the right of enrollment in primary and secondary education institutions up to the age of eighteen without needing to get student residence permit.

Foreigners with a family residence permit can apply for a short-term residence permit in the following cases:

  • In case of divorce, if he or she is married to a Turkish citizen and has stayed with a family residence permit for at least three years (However, foreigners who prove that they are victims of domestic violence by court decision are not required to have stayed with a family residence permit for at least three years.)
  • If the sponsor’s family stays in the country with a residence permit in the case of the sponsor’s death,
  • Those who have stayed in the country for at least three years on a family residence permit and are over the age of eighteen.

 How Many Years Can Family Residence Permit Be Issued for?

  • The family residence permit can be issued each time not exceeding three years.
  • The duration of the family residence permit cannot exceed the duration of the sponsor’s residence permit in any way.
